בבוקר (יום רביעי, 16.1) התקיים דיון בבית המשפט העליון בעירעור של המדינה
על החלטת בית-המשפט המחוזי להעביר את טלי פחימה למעצר-בית. הדיון
התקיימם אצל השופט התורן, אליקים רובינשטיין. רובינשטיין, בין היתר,
שאל את סניגוריה של טלי, עו"ד אביגדור פלדמן וסמדר בן-נתן, אם
הם מוכנים "להקשחת" מעצר-הבית, ואיך הם יכולים להבטיח שטלי
"האידיאליסטית" לא תחזור על מעשיה "כי לא נראה שהיא שינתה את דיעותיה
במעצר"...
רובינשטיין הבטיח לתת את החלטתט "בהקדם", עד ליום חמישי
בערב, יומיים לאחר הדיון, וארבעה ימים לאחר החלטת בית-המשפט המחוזי, לא
ניתנה שום החלטה. טלי פחימה יושבת בכלא בעינויים ובבידוד כבר 166
ימים.

ב-19.1. בן-נתן ביקשה לבטל את רוב סעיפי כתב האישום כיוון שהם מבוססים על
ראיות שהיו בידי התביעה עוד כששוחררה במעצר במאי 2004. אנא
השתדלו להגיע. חשוב להיות שם, למחות, להזדהות, ולעודד את טלי, שזו

Tali Fahima still in prison.
Rubinstein will give his decision "soon."
Judges Timen, Shapira, and Brosh will give their decision (on preliminary arguments) on Sunday, Jan 30th, at 8:30 am. Yesterday morning (Wed. Jan. 16),
the high court heard the state's appeal against the district
court's decision to place Tali Fahima under house arrest (instead of
prison). The judge on duty, Elyakim Rubinstein, asked Tali's attorneys,
Avigdor Feldman and Smadar Ben Natan if they would accept a
"toughening" of house-arrest terms, and how can they guarantee that
"idealistic" Tali will not repeat her actions "since it does not appear
that she has changed her opinions while under arrest..."
Rubinstein promised to give his decision "soon." At the
time of the writing of this note, Thursday night, two days after the
court hearing, four days after the district court's decision, a
decision has not been given. Tali Fahima has been in prison,
under torture and in solitary confinement for 166 days.

This coming Sunday, Jan 30th 2005, at 8:30 am, at the
Tel-Aviv district court (Weizmann St. at Shaul HaMelech), judges Timen,
Shapira, and Brosh will give their decision regarding preliminary
arguments made by defense attorney Smadar Ben Natan at the court
hearing of Jan. 19th. Ben Natan asked the court to nullify the majority
of the charges against Tali Fahima, since these charges were based on
evidence the prosecution had already obtained when Tali Fahima was placed under administrative arrest.
Please try to come to the court hearing. It's important
to be there, protest, show solidarity, and encourage Tali, for whom
it's the sole opportunity to meet friends and supporters.
